The legislative framework, Decree by Law No. 10 of 2026 Regulating Work in the Digital Commerce Sector (“Digital Commerce Law”) in the State of Kuwait was issued in the Kuwait Official Gazette on Sunday, 1 March 2026. The Digital Commerce Law marks a shift in the regulatory environment in Kuwait with respect to online shopping and commerce. It reflects the safe and competitive environment that encourages investment and innovation, contributing to the implementation of the Kuwait Vision 2035 and the target of digital transformation in the country.
With more than 45 articles, the Digital Commerce Law includes comprehensive procedural, supervisory, and punitive regulations that target the digital commerce sector of Kuwait. For instance, no person may work in the digital commerce sector without registering in the Ministry of Commerce and Industry registers. Failure to comply with the substantive articles include imprisonment or fines up to KD 10,000 (approximately USD 33,000), with the possibility of doubling the penalty in case of recidivism.
